ER Advisor

Role: Employee Relations Advisor

Purpose of role: As an Employee Relations Advisor you will work in conjunction with the Employee Relations Manager in order to maintain and improve colleague relations. You will follow the priorities set by the ER Manager as well as the P&C Executive, giving support on metrics, training and HR analytics.
You will act in liaison with the P&C In Store BP and P&C Admin and provide them with professional consultation and a timely answer.
You will assist the ER Manager in preparing for negotiations by providing background information.
Your role comprises the investigation and resolution of colleague complaints and grievances.

Reports to: Employee Relations Manager, Spain

Location: This role will be based in Madrid
Key Responsibilities:
  1. Provide legal advice on non-complex employment matters in coordination with ER Manager:
  • Consolidate and update corporate policies so that they will be distributed and used in training activities for Managers and Store Managers.
  • Provide legal advice to P&C ISBP and P&C Admin.
  • Support the ER Manager in providing legal counsel to Payroll, H&S and Systems.
  • Understand the business needs in order to provide advice on the best way to cover them.
  • Under the indications of the ER Manager, provide guidance on the interpretation and application of the CBA and legal regulations in force.
  1. Provide legal advice on Colleague Administration matters:
    • Support the ER Manager in providing guidance on Colleague Administration and Social Security.
    • Create with the ER Manager colleague Administration policies.
  2. Collective Bargaining:
    • Prepare all the background information and data required by the ER Manager on collective bargaining procedures.
    • Solve P&C Managers queries regarding works councils meeting.
    • Aid the ER Manager in negotiation the Gender Equiality Plan.
  3. Relations with unions:
  • Keep under control and follow up on union hours.
  • Keep union representation in the stores update.
  • Coordinate and prepare with the ER manager workers council election processes.
  • Support the ER Manager by preparing Powerpoint presentations for meetings with the unions.
  • Send the union’s fees monthly.
  1. Court cases and Labour inspections:
    • Preparation of Court cases on employment and Social Security matters in liaison with external lawyers.
    • Prepare all the evidence needed for Court cases.
    • Help P&C Managers prepare meetings with Labour Inspectors and prepare the relevant documents.
  2. Protocol Supervision
  3. Request from the stores
    • Solve queries from P&C ISBP and P&C Admin and Store Managers on employment matters, providing the relevant documents in each case (e.g. agreements, answer letters to colleagues, etc).
    • Advise P&C ISBP and Store Managers on conflicts with colleagues in the stores.
  4. Disciplinary procedures:
    • Apply disciplinary measures in agreement with the ER Manager and write sanction and dismissal letters.
  5. Training:
    • Provide training on employment matters to P&C ISBP and Stores Managers.
    • Prepare all training materials.
  6. Audits:
    • Support with the employment audits.
    • Assess the results and provide advice based on the obtained results.
  7. Data Protection:
    • Assist the ER Manager in the adoption of measures to apply GDPR in Spain in line with the indications given by the Data Protection Coordinator.
    • Help elaborate the relevant documents to comply with GDPR (e.g. documents’ retention guide, PIA assessments, website privacy notice, colleague confidentiality commitment, etc.).
    • Review all the material received from the Data Protection Coordinator and ensure its compliance with Spanish regulations.
    • Provide advice to the stores on data protection matters
  1. Invoice Management:
    • Requisitioner for all PO’s requested by the P&C Department.
    • Follow up and archive P&C Invoices.
Essential knowledge, skills and experience:
  • Experience in performing ER functions
  • Well – organised
  • Strong IT skills
  • Ability to write / amend ER – related documents
  • Ability to prepare and present training programs and materials
  • Confidenciality
  • Ability to investigate and analyse claims information and to draw conclusions
  • Flexibility to be proactive in a fast –paced, ever-changing environment
  • Degree in law, master’s degree in employment law would be a plus
  • Intermediate or Advanced level of English
  • Knowledge of current and emerging legislation, issues and trends as appropriate to the position
